1. Who We Are

Prism AI Analytics, LLC ("Prism AI Analytics," "we," "us," or "our") is a Charlotte, North Carolina–based AI and data consultancy. We help small businesses and startups make better decisions with clarity and confidence.

This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. It applies to prismaianalytics.com, our consulting engagements, our products sold or promoted through third-party marketplaces and platforms (such as Etsy, TikTok Shop, Gumroad, Pinterest, and Amazon Merch on Demand), our email communications, and any other service that links to this policy (collectively, the "Services").

2. Information We Collect

We only collect what we need to deliver our Services and run our business.

Information you give us directly

• Identity and contact details: name, email address, phone number, company name, job title.
• Project and consulting information: business goals, data systems, documents, and other content you share with us during discovery, assessments, or engagements.
• Order and product information: items purchased, download history, license keys, and customer support messages.
• Payment information: handled by our payment processors and the marketplaces themselves (e.g., Stripe, Etsy, TikTok Shop, Gumroad, Amazon). We do not store full payment card numbers on our own systems.
• Communications: emails, contact form submissions, scheduling requests, and survey responses.

Information we collect automatically

• Usage and device data: IP address, browser type, device type, operating system, referring URL, pages viewed, and time spent.
• Cookies and similar technologies: see Section 7 below.

Information we receive from third parties

• Marketplaces and shopping platforms: when you buy a product through Etsy, TikTok Shop, Gumroad, or Amazon Merch on Demand, or click through from Pinterest, those platforms share a limited set of order details (such as your name, shipping or billing region, and order ID) or referral data with us.
• Analytics and advertising providers: aggregated and de-identified traffic and engagement data.
• Public sources: business information from LinkedIn or company websites used for outreach research.

We do not knowingly collect sensitive personal information (such as government IDs, health, biometric, precise geolocation, or financial account credentials) unless a client explicitly provides it to us as part of an engagement, in which case we treat it under the confidentiality terms of that engagement.

3. How We Use Your Information

We use personal information to:

1. Deliver our Services — perform consulting work, fulfill orders, deliver digital products, and provide customer support.
2. Communicate with you — respond to inquiries, send invoices and receipts, share project updates, and provide product or order status.
3. Send marketing and educational content — only where permitted, and you can unsubscribe at any time.
4. Improve our Services — understand how the website and products are used, troubleshoot, and refine our offerings.
5. Protect our business — prevent fraud, enforce our terms, and meet legal, tax, and compliance obligations.

We do not sell your personal information, and we do not use it to train third-party AI models.

4. Legal Bases (for visitors in the EU/UK)

If you are in the European Economic Area or United Kingdom, we process personal data under one or more of the following legal bases: your consent; performance of a contract with you; our legitimate interests in operating and improving our business; and compliance with our legal obligations.

5. How We Share Information

We share personal information only with the following categories of recipients:

• Service providers that help us run the business — for example, hosting, email, payment processing, scheduling, analytics, customer support, and accounting tools.
• Marketplaces and platforms where our products are listed or promoted (Etsy, TikTok Shop, Gumroad, Pinterest, Amazon Merch on Demand, and similar), which have their own privacy policies governing your purchase or visit.
• Professional advisors such as attorneys, accountants, and insurers, where reasonably necessary.
• Authorities and others when required by law, to enforce our agreements, or to protect the rights, property, or safety of Prism AI Analytics, our clients, or the public.
• Successors in the event of a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

We do not sell personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law.

6. How We Protect Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, vendor reviews, and limited data retention. No system is perfectly secure, so we encourage you to use strong, unique passwords and to contact us promptly if you believe your information has been compromised.

We retain personal information only for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements.

7. Cookies and Tracking

Our website uses cookies and similar technologies to remember preferences, measure traffic, and improve the visitor experience. You can control cookies through your browser settings. Where required by law, we will request your consent before setting non-essential cookies. We honor Global Privacy Control (GPC) signals where applicable.

We may use third-party analytics services (such as Google Analytics) that collect aggregated usage data. These providers act as our service providers and process data on our behalf.

8. Your Privacy Rights

Depending on where you live, you may have rights to:

• Access the personal information we hold about you.
• Correct inaccurate or incomplete information.
• Delete personal information, subject to legal exceptions.
• Receive a portable copy of your information.
• Opt out of marketing emails (use the unsubscribe link or email us).
• Opt out of the sale or sharing of personal information for targeted advertising — we do not engage in either, but you may still submit a request.
• Withdraw consent where we relied on consent to process information.
• Appeal a decision we make about a privacy request.

To exercise any of these rights, email michele@prismaianalytics.com with the subject line "Privacy Request." We will verify your identity (typically by confirming details we already have on file) and respond within the timeframes required by applicable law (generally 30–45 days). You may designate an authorized agent to submit a request on your behalf; we will require written proof of authorization.

We will not discriminate against you for exercising any of these rights.

California residents

You have specific rights under the CCPA/CPRA, including the right to know the categories and specific pieces of personal information we collect, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share it. We have disclosed all of those above. We do not knowingly collect or sell personal information of consumers under 16.

Virginia, Colorado, Connecticut, Utah, Texas, and other state residents

You have similar rights under your state's privacy law and the right to appeal a denial of a request.

EU/UK residents

You may also lodge a complaint with your local data protection authority, though we ask that you contact us first so we can try to resolve the issue directly.

9. Children's Privacy

The Services are not directed to children under 13 (or under 16 in jurisdictions where that is the applicable age), and we do not knowingly collect personal information from them. If we learn that we have collected information from a child without verifiable parental consent, we will delete it. This applies equally to any Prism AI Analytics products listed through Etsy, TikTok Shop, Gumroad, Pinterest, Amazon Merch on Demand, or similar platforms — we do not market our products to children, and any buyer account, payment, and shipping data is handled by the platform, not by us.

10. International Transfers

We are based in the United States. If you access the Services from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your home country. Where required, we use appropriate transfer mechanisms (such as Standard Contractual Clauses) to protect your information.

11. Third-Party Sites and Marketplaces

Our website and emails may link to third-party sites, and our products may be sold or promoted through third-party marketplaces and platforms (Etsy, TikTok Shop, Gumroad, Pinterest, Amazon Merch on Demand, and similar). Those sites and marketplaces have their own privacy policies, and we are not responsible for their practices. We encourage you to review them before providing personal information.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top. If the changes are material, we will provide additional notice (such as a website banner or email). Your continued use of the Services after the effective date of any update constitutes acceptance of the revised policy.
